Syllabus

<p>Mandamus. Will not lie to compel board of supervisors to issue warrant in payment of claim for refund of taxes allowed by auditor and attorney general.</p> <p>Although the auditor and attorney general, acting under the provisions of section 4346, Code 1906 (section 6980, Hemingway’s Code), have allowed a claim for a refund of taxes erroneously paid into the county treasury, mandamus will not lie to compel the hoard of supervisors to issue a warrant in payment of such claim, since, under the provisions of section 311, Code 1906 (section 3684, Hemingway’s Code), the claimant has a plain, adequate, and speedy remedy in the ordinary course of law.</p>
