NEGLIGENCE – LANDOWNER – PREMISES LIABILITY: The trial court did not err in entering summary judgment in favor of defendant landowner on plaintiff's negligence claims where plaintiff, a business invitee, was injured after falling off of a ladder supplied by defendant while delivering fuel to an above ground fuel tank on defendant's property: defendant landowner did not owe a duty of care to the plaintiff where (1) climbing and descending a ladder is inherently dangerous (2) there were no latent or hidden defects in the ladder plaintiff used and (3) defendant did not actively participate in plaintiff's work.
