Syllabus

<p>Where the action in the District Court was founded upon a judgment in the Court of First Instance, and an appeal was taken from the judgment of the District Court, the record of the Court of First Instance was brought up by certiorari to this court, and the judgment was found invalid. The judgment of the District Court was reversed, and the case remanded.</p>
