<p>Decision of Appellate Cotjbt — Law of Case. — The decision of the appellate court upon any matter properly before it on the records becomes the law of the case in all subsequent proceedings therein.</p> <p>^Responsibility of Bailroad — Cannot Avoid. — A railroad company cannot avoid the responsibility of operating its road by allowing others to have the control and management of its roadbed or trains without the consent of the power whence it derives its franchises.</p> <p>(Syllabus by the court.)</p>
