Syllabus
<p>Where on appeal from an order granting a new trial the record shows that the motion was made upon several grounds without showing upon which of them the action of the Court below was based, the order will not be reversed if it was within the discretion of the Court to make it upon any of the grounds stated.</p> <p>The action of the District Court in granting a new trial on the ground of alleged insufficiency of the evidence, will not be interfered with when the evidence is conflicting, although the Appellate Court may differ in opinion with the lower Court as to the weight of the evidence.</p>
