<p>Tax-sale — Acknowledgment of deed in open court — -Minutes of court— Evidence-Notice — Act of March 13, 1815, 6 Sm. L. 299.</p> <p>A deed from'a county treasurer for land sold at a tax sale is not valid to pass the title without acknowledgment in open court and a record of the acknowledgment in the minutes of the court; and the minutes of the court-are the only-proper evidence of the acknowledgment.</p> <p>. Where there is no record of the acknowledgment of a tax deed in the minutes of the court, the fact that a purchaser from the former owner or his successor in title had actual notice of an acknowledgment in open court, is not sufficient to affect his title; inasmuch as a notice of an invalid or worthless title will not affect a title subsequently acquired by a purchaser for value.</p>
