MORTGAGE — BIGHT OP PATEE OP NOTE, WHO INDORSED IT AND APTEJB-WAED TOOK IT UP, TO ENPORCE MORTGAGE EXECUTED TO INDORSEE, WHILE he held it, to secure it. — The payee of a promissory note, wlio transferred it t>y indorsement, and afterward, on failure of payment by tbe maker, was compelled to take it up, is entitled to enforce a mortgage executed by tbe maker to tbe indorsee while be beld tbe note to secure it.</p>
