The defendant, Bryan E. Menge, appealed pro se from an order of the Superior Court denying his motion for a new trial. On appeal, the defendant argued that there were questions of material fact precluding the District Court from granting summary judgment in favor of the plaintiff, Ocean State Credit Union, and that this Court had the ability to review the District Court judgment. The defendant also contended, inter alia, that the Superior Court erred in changing the venue for the hearing on the motion for a new trial from Kent County to Providence County because his right to a fair hearing was prejudiced by the venue change. The plaintiff maintained that there was only a motion for a new trial on appeal and that the Court need not and should not indulge the defendant's wide-ranging implied and express requests beyond what was properly before the Court. <br><br>The Supreme Court held that the defendant filed a notice of appeal wherein he challenged the order denying his motion for a new trial. The Supreme Court determined that the defendant failed to provide this Court with a cogent argument that the trial justice overlooked or misconceived material evidence or was otherwise clearly wrong. The Supreme Court concluded that the defendant's remaining contentions had no merit.<br>Accordingly, the Supreme Court affirmed the order of the Superior Court.<br><br>
