Syllabus
The defendants in three actions to foreclose municipal tax liens appealed from the trial court's judgments denying their motions to open after the court rendered judgments of foreclosure for the plaintiff city. The defendants claimed that the court improperly failed to determine whether it lacked personal jurisdiction over the defendants due to insufficient service of pro- cess. Held: The trial court improperly failed to make a factual and legal determination regarding personal jurisdiction over each of the defendants, as the defen- dants clearly raised the issue of insufficient service of process as the basis for opening the judgments in their motions to open, which implicated personal jurisdiction, and, accordingly, the judgments denying the motions to open were reversed and the cases were remanded to the trial court to hold a hearing and to determine whether personal jurisdiction existed.
