Syllabus
<p>Evidence (68) — Best and Secondary — Pacts Evidenced by Writings. Tbe continuous interstate shipment of live stock may be shown by the testimony of a witness accompanying the shipment, in the absence of the original waybills, which cannot be regarded as the better evidence.</p> <p>Carriers (7) — Discrimination — Contracts Violating Regulations — Posting Tariffs. Since an interstate carrier’s failure to post its tariffs, as required by U. S. Compiled Statutes, 1916, § 8569, would defeat the purpose of the act to prevent discrimination in rates, posting need not be proven in an action to collect the difference between the rates actually charged and the carrier’s tariffs filed with the interstate commerce commission.</p>
