Syllabus
EXTRAORDINARY WRITS - habeas corpus petitioner's complaint does not allege facts showing that his maximum prison sentence has expired or that he is entitled to immediate release from prison. Rather, he is merely seeking a court order to correct his release date, for which a proper and adequate remedy is a writ of mandamus thus, petitioner's habeas-corpus claim is not legally cognizable the petition fails to state a claim on which habeas relief can be granted and the warden's Civ.R. 12(B)(6) motion to dismiss is granted.
