<p>Fraud in Contractor to improve Streets in San Francisco.—If the person who contracts with the Street Superintendent in San Francisco to improve a street, before the contract is made makes a private contract with a part of the owners of the lots liable to be assessed for the improvement to do their work for less than the price allowed by the contract, this private contract is in fraud of the law under which the streets are improved j but the fraud is no defense in an action by the contractor to recover the assessment, and must be taken advantage of by a remonstrance to or appeal to the Board of Supervisors.</p>
