<p>Trial — Right to Jury Trial — Legal Action and Equitable Cross-Complaint. Tbe plaintiff is not entitled to a jury trial on issues .raised by a complaint in an action to recover damages for breach, of a contract, where the defendant, admitting the contract, denied the breach and filed a cross-complaint alleging plaintiff’s breach and praying the foreclosure of a trust deed given by plaintiff as security for his performance, since the answer and cross-complaint converted the case into an equitable action.</p>
