<p>LIFE INSURANCE.</p> <p>Marvin, Winch and Henry, JJ.</p> <p>Line INSURANCE — Brothers have no Insurable Interest in Each Other’s Lives jtrom Mere Relationship.</p> <p>One who takes out a policy of insurance on the life of his brother without the knowledge of the latter, and for the avowed purpose of providing for the funeral expenses of the insured, who is indigent but who is young and in good health, has no such insurable interest in the life of the insured as would enable him to maintain an action against the company to reform the contract of insurance, incorrectly made out by the company’s agent, and to recover from the company the amount of the policy, on the death of the insured.</p> <p>[Syllabus^ approved by the court.]</p>
