<p>Syllabus.</p> <p>A preliminary injunction is properly refused to a railroad corporation which has brought a suit against the city of New Orleans to have adjudged to belong to it a certain railroad franchise which the Council has advertised for sale— the plaintiff alleging that it had been and was still in possession of, and enjoying the franchise.
