Syllabus

<p>Where an uneducated person deliberately executes a lease, receives and retains a copy of it, and makes several payments which are credited by the lessor as rent in a book kept by the lessee, this lease may not afterwards be explained away, and a trust ex maleficio imposed upon lessor’s land in favor of the lessee, by inconsistent parol testimony.</p>
