Syllabus
<p>Appeal—Time of Taking—Review of Evidence.—Under Code of Civil Procedure, section 939, permitting an appeal within a year of entry of judgment, but inhibiting consideration of an exception to the decision, as being unsupported by evidence, unless the appeal is within sixty days after rendition of judgment, the evidence cannot be considered on an appeal taken after the sixty days.</p> <p>Nonsuit—Exceptions.—Error in Granting Nonsuits is an error in law which must be excepted to that it may be considered on appeal.</p>
