Syllabus

<p>1. Master and Servant — Contract oe Employment — Reconduction.</p> <p>There can be a tacit reconduction in matter of a written contract between the employer and the employe.</p> <p>2. Same — Termination.</p> <p>The tacit reconduction may be terminated by either party.</p> <p>3. Same — Notice.</p> <p>The contract was terminated after formal notification by defendant to plaintiff of unwillingness to retain the latter’s services.</p> <p>4. Same — Rights under Contract.</p> <p>Prior to notification, the plaintiff is entitled to the price, similar in amount, paid under the contract.</p> <p>5. Same.</p> <p>Having tacitly consented to let the services continue, it is bound to pay for this service to the date that the plaintiff was notified to leave with its apparatus.</p> <p>(Syllabus by the Court.)</p>
