Syllabus

<p>Where a husband, in consideration of a fixed sum, executed an assignment of his interest in his wife’s estate, to the executor named in the will of his wife made before her marriage and not republished, in trust for the purposes designated in the will and in a proposed codicil which was not executed, the relation between the husband and the executor, at the date of the assignment, was not that of cestui que trust and trustee. The assignment was an absolute conveyance, in trust, and was irrevocable.</p>
