Syllabus

The trial court did not err in setting aside the certificate of title issued to appellant where appellant failed to demonstrate he obtained ownership of the vehicle by means of an execution sale. Because evidence demonstrated the vehicle was owned by an individual who died in 2006, the trial court properly dismissed the petition upon concluding that the probate court had exclusive jurisdiction over ownership and title to the vehicle.
