<p>Election or Remedies. Principal and agent. Suit against either. Estoppel to sue other. Knowledge,</p> <p>A creditor, who has at his election a right of action against either a principal or an agent, and who, with full knowledge of all the facts, sues either and prosecutes his suit to final judgment, cannot thereafter sue the other and recover, although he were unsuccessful in the first suit.</p>
