<p>On Defendants’ Demurrer.</p> <p>Fifth amendment; taking; liability. — Where a coal company has contracted to furnish coal at an agreed price per ton to certain steamship companies, and the Government, under its war power, has required the said coal company to furnish such coal to other parties at a lower price per ton fixed by the Fuel Administration, it is not a taking under the fifth amendment to the Constitution, and the United States is not liable for the difference in price. •</p>
