<p>CONTRACT TO CONVEV— COVENANT AGAINST INCUMBRANCES — RESCISSION.</p> <p>The delivery of a deed reciting that the land conveyed is free from incumbrance, when, in fact, there is a mortgage upon it, is not a performance of a contract to convey free from incumbrance, and the grantee has the right to rescind the contract.</p>
