Syllabus

<p>Riparian Bights—Injunction Against Nonriparian Owner—Harmless Diversion.—A riparian owner cannot enjoin the diversion of water above him on the stream by a nonriparian owner, when the amount ■diverted would not be used by him, and would cause no loss or injury to him or to his land; nor when he fails to make out his right in equity, and to show an injury for which money damages will not give him adequate compensation.</p>
