MICHAEL HERTZ ASSOCIATES, 19 I&N Dec. 558 (Comm. 1988) ID 3046 (PDF) An industrial designer who has a baccalaureate degree in industrial design from an accredited college or university in the United States or a degree from a foreign college or university which is evaluated as equivalent to the United States degree is a member of the professions within the meaning of section 101(a)(32) of the Immigration and Nationality Act, 8 U.S.C. § 1101(a)(32)(1982), and is eligible for classification as a person of distinguished merit and ability pursuant to section 101(a)(15)(H)(i) if the job offered requires such a professional.
