A., president of a bank, and B., having agreed to buy a barge load of staves for their joint account, and B.’s check for the purchase price having been paid by the bank, under the direction of A., and charged to the account of</p> <p>A. & B., and the barge having thereafter been consigned to a dealer in another place by B., who was fully authorized by A. to dispose of it, and the dealer having settled with B. for the price of the staves, the bank has no standing to recover such price from the dealer.</p> <p>(Syllabus by the Court.)</p>
