Syllabus
<p>If the record in proceedings to designate a curtilage subject to mechanics’ lien, under the act of June 16, 1836, contains no irregularity, the decree will be affirmed on certiorari. '</p> <p>In such proceedings the court has power to set aside the report of the commissioners and appoint others.</p> <p>The act requires notice of the appointment of commissioners to be given to the parties interested, but requires no notice of the time of view.</p> <p>The extent of the curtilage necessary for the use of the building rests in the discretion of the commissioners and the court below.</p> <p>Note. — 'The method of determining the curtilage, where there is a dispute . as to the land bound, is now fixed by the act-of June 4, 1901 (P. L. 431) § 23.</p>
