Syllabus

<p>Partnership — Parties—Joint action — Bes adjudicata — Judgment.</p> <p>Where in an action by a partnership, the defendants set up a claim against the partnership, and secure a certificate in their favor upon which judgment is entered, they cannot maintain a second suit on exactly the same cause of action against one of the plaintiffs in the first suit and two other persons alleged to be partners, but not parties plaintiff in the first suit.</p>
