Syllabus
<p>CONTRACT BETWEEN RAILROADS — CONSTRUCTION.</p> <p>1. Defendant constructed, in accordance with agreement, a depot building on plaintiff’s land for the joint use of both.</p> <p>2. The volume of business having greatly increased, the depot is not adequate to the business.</p> <p>3. Plaintiff, because of the agreement, has the right to resume possession, and defendant ample time to remove its building.</p> <p>4. Defendant’s right to bring suit for expropriating land for its depot is reserved.</p> <p>(Syllabus by the Court.)</p>
