Syllabus

<p>Where there is a conflict of testimony given on a trial before a referes, and liis finding is in favor of a party upon the facts, this court will give the same effect to the finding as to the verdict of a jury, especially where such finding is supported by a preponderating number of witnesses who are not .impeached.</p>
