<p>Witnesses. Statutory prohibition against disclosure by physician of communications of patient survives patient’s death and cannot be waived by his heirs, ejecutor, or administrator.</p> <p>The prohibition of section 3695, Code 1906 (section 6380, Hemingway’s Code), against the disclosure by a physician or surgeon of communications made to him by a patient, except at the instance of the patient, survives the death of the patient,’ and and cannot be waived by the patient’s heir, executor, or administrator.</p>
