<p>Negligence — Master and servant — Dangerous machinery — ■ Guards — Nonsuit—Act of May 2,1905, P. L. S52.</p> <p>In an action to recover damages for injuries alleged to have been occasioned by the negligence of the defendant in failing to properly guard an emery wheel, as required by the Act of May 2, 1905, P. L. S52, a nonsuit was properly entered where at the trial plaintiff established the fact that the wheel was guarded and there was no testimony that the guard provided was not a proper guard.</p> <p>Mr. Justice Moschzisker dissents.</p>
