<p>' 1. Practice — Set ore — Appear Prom Justice’s Court.— T. brought bis suit against M. in tbe justice’s court, and obtained a judgment. M. tools: an appeal to tbe circuit court. In that court M. obtained leave of tbe court, and filed a set-off, for tbe first time, on the motion of counsel; tbe court refused to permit him to offer any proof in support of bis set-off because no set-off was filed in tbe justice’s court; held, that tbe circuit court ruled correctly. Rev. Code §§ 1305,1306, 1334</p>
