Syllabus

<p>Appeals — Penalty for delay — Practice, 8. G. — Act of May 25, 1874.</p> <p>The penalty provided by the Act of May 25, 1874, P. L. 227, for taking an appeal for delay, will be imposed by the Supreme Court where it appears that the appellants, after taking the appeal, allowed the ease to be nonprossed after a year’s delay, without ever having the record of the lower court prepared for removal, and without having prepared a paper-book, and after having taken another appeal from an interlocutory decree which they never pursued to final hearing.</p>
