<p>(Syllabus by the Com-t.)</p> <p>Appeal and Error <&wkey;436 — Issues Not Determined-Trial Pending Appeal.</p> <p>Where an appeal has been allowed from a judgment which clearly and definitely disposed of only one of the matters set up in the pleadings, the parties to the suit may proceed with reference to the other matters not disposed of by the judgment, and which were clearly and intentionally not covered by the judgment.</p> <p>[Ed.
