<p>Mandamus — When Lies.</p> <p>Where the district judge refused to grant a preliminary injunction, the remedy of the plaintiff is by appeal, and not by mandamus, except in cases where the issuance of the writ is made the statutory duty of the judge.</p> <p>[Ed.
