Syllabus

<p>Implied Trust.—An implied, trust cannot exist in respect to a claim of title to land, which claim is without foundation.</p> <p>Implied Trust as between Cotenants. — If one of two tenants in common, who have the title to land in fee, buys in an outstanding claim of title which is void, without an agreement to purchase for the use of his cotenant, an implied trust cannot be raised in favor of his cotenant as to the void claim thus purchased.</p>
