<p>SYLLABUS BY THE COURT.</p> <p>Gift — Acceptance—Presumption—Question of Fact. Acceptance by the donee is necessary to constitute a gift. The presumption of acceptance on the part of the donee, sometimes indulged by the law, is a presumption of fact, and becomes effectual only in the absence of evidence. Where such acceptance is disputed a question of fact arises, which must be determined upon the evidence presented.</p>
