Syllabus
<p>1. Arrest of judgment—Practice-—A motion in arrest of judgment, based upon an alleged defect in the petition, should be overruled, if the petition would be sufficient on demurrer.</p> <p>2. Charge—A charge to the jury which confines them to consideration of one kind of evidence is ert-oneous, if evidence of a different kind, but relative to the same point, is adduced. See opinion.</p>
