<p>On Defendants’ Demurrer to Second Amended Petition.</p> <p>Contract; misrepresentation. — -Where a contractor voluntarily uses a Government pier, previously constructed by another contractor for an entirely different purpose, as part of a cofferdam to be constructed by him, he can not maintain an action against the Government for misrepresentation because the pier was not built in strict accordance with the specifications.</p>
