Syllabus

<p>Railroads: killing stock : defective fence. A railroad company cannot be held liable under E. S., section 809, for the killing of stock occasioned by defective fencing, unless it appear that it knew or might, by the exercise of reasonable care and diligence, have known that its fence was out of repair, and that a reasonable time had elapsed after the acquisition of such knowledge, or after the time such knowledge should have been acquired, in which it should have repaired it.</p>
