<p>AUCTIONEER — RICENSE TO CORPORATION-ACTION ON BOND.</p> <p>1. Where a corporation executes and records a bond as auctioneer, and solicits business as such, and receives goods as such to be sold and proceeds accounted for, in a suit against the corporation and the surety on the bond for the price of the goods the defendants will not be permitted to urge that the corporation could not be an auctioneer under the law, and was not such in fact. They are estopped from setting up the defense.</p> <p>(Syllabus by the Court.)</p>
