<p>SYLLABUS (BY THE COUBT).</p> <p>1. Where appellant has failed to file assignments of error, within the time required by sec. 21, chap. 57, L. 1907, as amended by sec. 2, chap. 120, S. L. 1909, and advantage is taken of such failure by motion to dismiss before such default has been cured, in the absence of a satisfactory showing, excusing the default, the (appeal will be dismissed.</p>
