<p>SYLLABUS BY THE COURT.</p> <p>Former Recovery — Bar, When. — A judgment in replevin for defendants, appearing to have been rendered on the merits of the controversy, is a bar to any recovery by plaintiffs in a subsequent action of trespass between the same parties for the same taking of the same goods.</p>
