<p>Will — Trusts and trustees — Use of income.</p> <p>Where a testatrix gives one-half of her estate to one of her daughters in trust to apply the “income or so much thereof as it may be deemed necessary” for the comfortable maintenance and support of another daughter who was weak-minded, and upon the death of the latter to pay over the principal to the trustee’s children, and testatrix knows at the time of the making of her will that the weak-minded daughter had an independent estate sufficient for her every want, the trustee, who has taken the sister into her own home in accordance with a request in the mother’s will, is entitled to an allowance for the support and maintenance of her sister out of the income of the trust estate, notwithstanding the existence of the other independent estate.</p>
