<p>JUDGMENTS — BES JUDICATA-MATTEBS CONCLUDED.</p> <p>Where the judgment itself m an action discloses that a part of the subject matter of the controversy was not determined, such judgment cannot be invoked as a former adjudication for the purpose of barring a subsequent action brought for the purpose of obtaining an adjudication upon an issue undetermined in the prior action.</p>
