<p>RAILROADS — INJURY TO PERSON ON TRACK.</p> <p>1. Where a person lying upon a railroad track is run over by a passing- engine and killed, and it appears from the evidence that there was no negligence on the part of those in charge of the engine, either in the matter of keeping a lookout, or in endeavoring to avoid the accident after the discovery of the danger, there is no principle of law and no precedent which would authorize the awarding of damages against the railroad company for the killing.</p> <p>(Syllabus by the Court.)</p>
