Syllabus
<p>A national bank commenced an action in a Circuit Court of the United States to have an assessment of the shares of its capital stock made by state officers declared invalid. The defendants demurred upon the ground that the remedy was in equity. The demurrer was overruled, the case went to trial before a jury, and the plaintiff obtained judgment: Held, That, although the proceedings might have been in accordance with practice in the courts of the State, the plaintiff’s remedy was in equity according to practice in ‘the Federal courts, and that the demurrer should have been sustained.</p>
