Syllabus

Even if the trial court should not have taken judicial notice of the filing date of documents on the Secretary of State's website, the appellant was not prejudiced because the record before the trial court contained the file-stamped documents. The trial court correctly entered summary judgment against the appellant for money due under a subscription agreement where the evidence established that the appellant was personally liable. The trial court did not err in failing to rule that the appellant acted as a \pre-incorporation promoter.\ The appellant never raised that argument below in summary judgment proceedings. The trial court did not err in failing to sustain the appellant's competing summary judgment motion. Judgment affirmed.
