Syllabus

<p>1. An instruction, assuming as proved a material controverted fact, is erroneous.</p> <p>2. The plaintiff is confined in his recovery to the cause of action alleged in his declaration, and the instructions of the court must be confined to the issues made by the pleadings.</p>
